Key Points of New Tentative Agreement

August 5, 2010 

This document provides a summary of the key points in the new tentative agreement.  Please review before voting.  For more detail and a complete package of the changes to the current collective agreement, please refer to either of the following websites:

1. Term: Subject to ratification, the new tentative agreement will amend the current collective agreement to its expiry on December 31, 2011 and will then be automatically renewed starting January 1, 2012 to December 31, 2014. 
2. Wages:
  • There will be a wage freeze for the years 2012, 2013 & 2014.
  • The January 1, 2011 increase of 1.75% will be remain as per the current collective agreement.  (This is a change from the previous tentative agreement which deferred the implementation of this increase to July 1, 2011.)  
3. 146 Days of Strike Time: This stays as it is today in the current collective agreement.  Members who retire on or before Dec 31, 2011 will receive the 146 days for pension calculation. 
4. OPEB’s (Other Post Employments Benefits): Members who retire by the end of 2014, will be guaranteed their current OPEB entitlement.  This includes the grandfathered and up to $1000 calculation benefit. 
5. Security:
  • There is a guarantee that there will be no consolidation of work that would force an employee to choose between relocation to a new community to keep their job or to leave the company.  This includes the announced plans with respect to Regional Services, CSO and E&ITS. 
  • There is also a separate letter to the union stating that for the life of the collective agreement, the five (5) existing Contact Centres will stay open during the life of the collective agreement.
6. Reduction of Contractors: There is a commitment to reduce the # of contractors in 10 major centres in the CST classification by 50% over the next 3 years.  This will be accomplished by…
  • The implementation of a CST Labour Pool whose wages and working conditions differ from those of regular and part-time employees.
  • A Project Term Workforce can be created in order to complete project work which will last for a relatively short, definable period.  
  • The company will not increase the ratio of contractors (Full Time Equivalent’s – FTE’s) to employees doing CST, BST, NT or CT repair work outside of the Ten Cities.   
7. Combination/Community Technicians: Karen Sheriff’s announcement included “evaluating workloads and transferring technicians based on workload demand.”  That means that if a rural technician does not currently have a full workload, that technician could be permanently transferred to an area where they will have a full workload.  They will be backfilled by a contractor.  Designating combination/community technicians in rural/remote areas will help to ensure that technicians stay working in their communities.  It will help to reduce the need for transfers to more urban areas due to lack of work. 
   
8.  Remote Call Monitoring (RCM): This is new to contact centres and will apply to Front-line BSR’s, CSR’s, Helpdesk Reps, Operators and Telesales Reps.  There will be an introductory period of 24 months where RCM will be used only for coaching purposes.  There will be a maximum of 10 calls / month / representative, which will be scored by the Quality Assurance Reps.  There will be 2 joint union/management committees struck to deal with RCM program issues.  The committees will develop scoring criteria, sampling criteria, feedback criteria and any other details as required.  
9. Sales Incentive Program: This program applies to CSR’s in the Consumer Inbound Queue, BSR’s in the PBQ and Telesales Reps.  Participation in the program is voluntary.  It provides an annual financial payment to participants who meet certain sales criteria provided the company achieves certain revenue criteria.   
10. All Other Rights in the Current Collective Agreement: Remain in tact until the end of 2014.  That means everything in Article 12 (bumping, layoff language etc), Pensions, SDB etc.

New Tentative Agreement

Sisters and Brothers,

We are pleased to announce that the union and company have reached a new tentative agreement which proposes an expiration date of December 31, 2014. The new agreement, if accepted, will remove the need for the cost cutting initiatives announced by Karen Sheriff on July 15, 2010. In order for the agreement to take effect, it must be ratified by the membership. The CEPACC Executive recommends acceptance of the new tentative agreement.

If accepted, the agreement provides for the following:

  • The 5 existing contact centres will remain open for at least the life of the agreement.
  • There will be no consolidation of work that will result in any current regular employee being forced to retire, resign or transfer to a reporting centre greater than sixty (60) km from their existing reporting centre.
  • OPEB’s as they are currently offered, will be protected for the life of the collective agreement.

    Contractor reduction initiatives will proceed in the form of a Project Term Workforce and a CST Labour Pool.

    As in the previous tentative agreement, in exchange for the employment security there will be no wage increases for 2012, 2013 & 2014.
  • The 1.75% wage increase will take effect on January 1, 2011 as originally scheduled in the current collective agreement.
  • The 146 days of pensionable service that was lost during the strike will remain available to members who retire by December 31, 2011.
  • Some dates in the previous tentative agreement have been adjusted to coincide with the new signing date.

Taking into account the time of year and that this agreement, which is very similar to the previous agreement, was presented to the membership in the past couple of months, we have decided to do a mail-in ballot. Ballots will be mailed to member’s home addresses by August 13, 2010 and will be counted on Sept 15, 2010. We are working out the other logistics of the vote and are also exploring opportunities for members to discuss the new agreement. More details will be communicated in the very near future.

Common Interest Forum Update

Sisters and Brothers,

As you know, we were scheduled to meet with the company July 26 & 27 to explore options to alleviate any impact to members of the company’s latest cost cutting initiatives announcement. 

Late last week, questions were raised with the National Executive.  National President Dave Coles wanted to review the situation with other Officers of the Union before we commenced talks with the company.  A conference call of several National Officers and National Representative Chuck Shewfelt for the council has now taken place and we have been given the green light to proceed. 

 We are meeting with the company today, July 27 at 5:00pm and most likely will continue into Wednesday.

 We know that it is stressful waiting for news.  We will issue a membership bulletin with an update as soon as possible.  We apologize for this unavoidable delay in the proceedings.

Young Worker Wins National Award

The Local 410 executive board would like to express out congratulations to Brother Ryan Strickland, of the Clarenville Unit.  Ryan was just awarded the National Young Worker’s Committee Convention Participation Initiative.  This prestigious award means that Ryan will travel to the 2010 CEP National Convention as a guest of the National Young Worker’s Committee.  Congrats Brother!

Sisters and Brothers,

Since the company’s announcement last week, we have heard from many members who are concerned and worried about their future.  There have been some mass e-mails and we understand that a petition is circulating. 

As mentioned in our membership bulletin last week, we are meeting with the company on July 26th & 27th.  We will explore many options to try to alleviate any impact this announcement has on members.  Until that meeting is concluded, we cannot speculate on the outcome.  We will issue a bulletin next week as soon as we have any news. 

Obviously, this is a very stressful time for everyone involved.  If you have any comments or thoughts to share, please e-mail any one or all of us.  We will respond to you as soon as possible.

Sisters and Brothers,

Earlier today, the Company announced its plans to cut costs following the rejection of the recently proposed tentative agreement.  These initiatives include increased contracting out, contact centre closures, additional consolidation and the elimination of the OPEBs (Other Post Employment Benefits) program.

In our message to members two weeks ago, we told you that we had scheduled a meeting with the company on August 3 & 4.  That meeting has now been pushed up to July 26 & 27 so we can discuss this latest announcement, get more information and determine if there is anything we can do to prevent some or all of these cuts.

We understand that this is a very stressful and uncertain time for all members.  We will do everything in our power to mitigate the impact of this announcement.
